Q. Does everybody need to make a Will?
A. Yes. A Will ensures that your property is distributed in accordance with your wishes. It is a good idea to have a lawyer draft your Will to make sure the intention in the Will is certain. If a person dies without a Will, the property of the person is distributed in accordance with the rules of intestacy.
 
Q. If I separate from my spouse, should I make a new Will?
A. Yes. Until a divorce is completed you have the status of a married person. Until a divorce, your estranged spouse is a major beneficiary of your estate where you do not have a valid Will indicating that your estranged spouse is not a beneficiary.
 
Q. What is a Power of Attorney?
A. It is a legal document authorising a person to act on behalf of another person. It enables the person named as the Power of Attorney to do anything that the person granting it would be legally entitled to do.
 
Q. Are there different kinds of Powers of Attorney?
A. There are 4 main types of Powers of Attorney. They include:
1. Specific or General Powers of Attorney
2. Enduring Power of Attorney
3. Enduring Power of Attorney (Medical Treatment)
4. Enduring Power of Guardianship
